Contract of Employment
For Foreign Experts and Teachers

Example:

   Yunnan University of Finance & Economics (hereinafter referred to as Party A) and (hereinafter referred to as Party B) agree to sign this contract and pledge to fulfill conscientiously all the obligations stipulated in it.

I. The period of service will be from the 1st day of Sep. 2003 to the 31st day of July , 2004 .

II. The duties of Party B:
Party B shall undertake a minimum of 12 hours and a maximum of 16 hours of teaching per week and other engagements assigned by Party A.

III. Party B's Obligations
A. Party B shall observe the laws, decrees and relevant regulations enacted by the Chinese government and Party A's work system (e.g. to complete the teaching tasks on schedule, to observe Party A's daily work schedule, not to accommodate a guest before consulting Party A, not to stay overnight out of the campus without informing Party A in advance and the like).
B. Party B shall cooperate positively with Party A and complete the tasks agreed on.
C. Party B shall accept Party A's arrangement in regard to his work. Without Party A's consent, Party B shall not render teaching service elsewhere or hold concurrently any post unrelated to the work agreed on with Party A.

IV. Party A's Obligations
A. Party A shall take full account of Party B's reasonable demands and meet them positively.
B. Party A shall on its initiative invite Party B to participate in the relevant teaching activities, and jointly consult on teaching arrangements.
C. Party A shall cooperate positively with Party B and provide Party B with necessary and possible facilities to fulfill the teaching tasks.

V. Party A shall pay Party B monthly salary of____________ Yuan (RMB), 70% of which can be converted into foreign currency monthly. Party B shall pay 100 Yuan (RMB) as charge for electr city and water monthly.

Party A shall bear the following expenses for Party B during his working period in China:
1. Accommodation equipped with furniture, color TV, bedding, refrigerator, toilet and telephone. (Cost of telephone is to be paid by Party B).
2. Party A's Medical Clinic shall provide Party B with free medical consulting services at no expense to Party B. (The expenses of medical services incurred at any other medical units shall be paid by Party B.)
3. Party A shall provide Party B, whose actual working period is at least one year, with traveling allowance of 2500 Yuan (RMB) each year.
4. Party A shall refund to Party B 50% of the return economy air ticket or a one-way ticket back to the home country for Party B at the end of one years service.

VI. Revision, Cancellation and Termination of the Contract
1. Should Party A want to terminate the contract before it expires, Party A shall give a reasonable explanation to Party B and notify Party B of such a termination a minimum of thirty days in advance. Party A shall pay Party B salary respectively stipulated within the contractual period.
2. Should Party B want to terminate the contract before it expires, Party B shall submit a written notice to Party A thirty days in advance. Party A shall stop paying Party B salary and stop providing any service and duty to Party B from the day when Party A consents to the termination request of Party B. Party A is entitled to claim compensation for any loss caused by Party B's termination of the contract, which shall not exceed Party B's total amount of salary received in the period before the termination.
When either of the two parties requires terminating the contract, the contract shall continue until the termination is agreed upon by the other party.
VII. Party A has the right to cancel the contract under the following conditions:
1. If Party B violates any regulation in Items I, II and III of the contract and fails to amend these issues after Party A has pointed it out, Party A has the right to cancel the contract and arrange for Party B to return to their country within thirty days. If this occurs, Party B shall pay the cost for their own air ticket and transportation of luggage.
2. Party B's sick leave must be supported by the submission of a doctor's certificate. If Party B applies to Party A for sick leave, which does not exceed thirty days in succession, Party B will receive his full normal wages. If Party B fails to resume normal work after a continuous 30-day absence due to illness which has been diagnosed by the YNFTI doctor of School Clinic, Party A may arrange, in consideration of Party B's health, for Party B to return to his country within a month, and the contract is terminated accordingly.

VIII. The contract takes effect on the date when Party B comes to this post and becomes invalid immediately upon the expiration of the contract. If either of the parties ask to extend the contract of employment, the request shall be forwarded to the other party two months prior to the expiration of the contract. The renewed contract shall be signed by both parties with mutual consent.
At the completion of the contract period, Party B shall bear all expenses incurred when staying on after the contract expires.
The contract is written in both Chinese and English, both the texts being equally authentic.
